1. Acceptance of Terms
By accessing or using BreachGuard ("the Service"), operated at breachguard.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
BreachGuard is a breach monitoring service that checks email addresses and domains against known data breach databases and alerts users when their information appears in compromised datasets. We aggregate data from publicly available breach databases, licensed threat intelligence feeds, and third-party services such as Have I Been Pwned (HIBP).
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
4. Acceptable Use
You agree not to use the Service to:
- Monitor email addresses or domains you do not own or have authorization to monitor
- Attempt to access breach data beyond what is provided through the Service
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service for any illegal or unauthorized purpose
- Interfere with or disrupt the Service or its infrastructure
- Resell, redistribute, or sublicense access to the Service without written consent
- Use automated tools to scrape or extract data from the Service beyond API rate limits
5. Payment, Subscriptions & Refunds
Paid plans are billed on a monthly recurring basis through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on each billing cycle.
- Prices are listed in USD and may be updated with 30 days' notice
- You may cancel your subscription at any time from your account settings
- Cancellation takes effect at the end of the current billing period
- We do not offer prorated refunds for partial billing periods
- Refund requests for the current billing cycle may be considered within 7 days of payment on a case-by-case basis
6. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. In particular:
- We monitor publicly available and licensed breach data sources. We do not guarantee complete coverage of all data breaches that have occurred or will occur.
- The absence of a breach alert does not mean your data has not been compromised — it means your information was not found in the sources we monitor.
- We do not store or provide access to breached passwords, financial data, or other sensitive credentials.
- BreachGuard is a monitoring and alerting tool, not a security solution. We are not responsible for preventing breaches or securing your accounts.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREACHGUARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT; (C) ANY BREACH DATA THAT WAS NOT DETECTED BY THE SERVICE; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may also delete your account at any time from your account settings. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the revised Terms, please stop using the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
